REQUEST FOR RELEASE OF FUNDS

On or about August 15, 2023 Gadsden County will submit a request to the Florida Department of Commerce (formally the Florida Department of Economic Opportunity) for the release of Community Development Block Grant funds under Title I of the Housing and Community Development (HCD) Act of 1974, as amended, to undertake a project funded by the Florida Small Cities Community Development Block Grant program in the amount of $750,000, plus $50,000 in non-HUD funds to be contributed to the project as local match from the Gadsden County State Housing Initiative Partnership (SHIP) program.  The project is for multiple years, including 2023, 2024, and 2025 and will include the rehabilitation and/or demolition and replacement of housing occupied by very low, low, and moderate-income persons.  Project activities will also include temporary relocation and grant administration.  All project activities will take place within the unincorporated area of Gadsden County. 

Gadsden County has determined that the activities proposed in the Unspecified Site Strategy are categorically excluded under HUD regulations at 24 CFR Part 58 from the National Environmental Policy Act of 1969 (NEPA) requirements.  As eligible sites are located, site specific checklists will be completed prior to the commitment of funds for each unit.  Additional project information is contained in the Environmental Review Record (ERR) on file at the Edward J. Butler Governmental Complex located at 9-B East Jefferson Street, Quincy, Florida 32353.  

PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the Environmental Review Record (ERR) to Sonya Burns at P.O. Box 1799, Quincy, Florida 32353.  Additional project information is contained in the ERR on file at the Edward J. Butler Governmental Complex located at 9-B East Jefferson Street, Quincy, Florida 32353  and may be examined or copied weekdays 8:30 A.M. to 4:30 P.M.  All comments must be received by August 14, 2023.  Comments will be considered prior to Gadsden County requesting a release of funds

RELEASE OF FUNDS

Gadsden County certifies to the Florida Department of Commerce and HUD that Kimblin NeSmith in his capacity as Chairman of the Gadsden County Board of County Commissioners, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied.  The State’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows Gadsden County to use the CDBG funds.

OBJECTIONS TO RELEASE OF FUNDS

The Florida Department of Commerce will accept objections to its release of funds and Gadsden County’s  certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of Gadsden County; (b) Gadsden County omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the County committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by the State; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures at 24 CFR Part 58, Sec. 58.76 and shall be addressed to the Florida Department of Commerce, CDBG Program, MSC-400, 107 East Madison Street, Tallahassee, FL 32399-6508.  Potential objectors should contact Gadsden County to verify the actual last day of the objection period.
